PLEASE READ CAREFULLY. These Terms and Conditions form a contract between Customer and UrbanScooters.com and relate to your use of this website and the purchase of any merchandise from this site. BY CHECKING THE BOX THAT STATES, "I AGREE TO THE TERMS AND CONDITIONS OF THIS WEBSITE.," YOU ARE ENTERING INTO A CONTRACT WITH URBANSCOOTERS.COM. IF YOU DO NOT AGREE, DO NOT CHECK THE BOX AND DO NOT USE THIS SITE.
CUSTOMERS RESPONSIBILITIES AND LIMITATION OF LIABILITY
Customer acknowledges that UrbanScooters.com only sells transportation and related products ("Product(s)") from manufacturers that warrant their products. In consideration for the low pricing margins provided to customers by UrbanScooters.com, customers purchasing from UrbanScooters.com agree that their sole recourse for product liability shall be to the manufacturer of the Product(s) and/or a return of the Product(s) to UrbanScooters.com pursuant to the UrbanScooters.com return policy set forth on this website, as amended from time to time.
Customers warrant and agree that they will operate Product(s) purchased from UrbanScooters.com for their proper use, in a safe manner (see, "Scooter Safety" on this web site which is incorporated herein), and under normal operating conditions. Normal operating conditions require adherence to manufacturer's specifications in the owner's manual, and routine care and maintenance by the purchaser of the Product(s). Proper use means that the Product(s) are to be used only in the manner intended for personal transportation of a single rider with proper safety equipment on smoothly paved, safe, dry, non-oily surfaces in accordance with local regulations during daylight hours. The buyer is aware that the products on this Site are designed for recreational and/or for personal transportation of a single rider with proper safety equipment. They are not suitable for handicapped persons or persons with limited mental or physical capacities.
Customer acknowledges and understands that the U.S. Consumer Product Safety Commission recommends the following safety guidelines to help prevent scooter deaths and injuries and Customer agrees to follow the following guidelines:
* Wear a helmet, along with knee and elbow pads. (Wrist guards may make it difficult to grip the handle and steer the scooter.)
* Ride on smooth surfaces. Avoid dirt, sand, gravel and water, which can cause falls.
* Do not ride scooters at night.
* Don't ride scooters in traffic.
* Wear sturdy shoes.
* Children under age 8 should not use non-powered scooters without close adult supervision.
* Children under 12 should not ride motorized scooters.
* Owners of motorized scooters should check with local authorities for riding guidelines and restrictions. Many local jurisdictions prohibit the use of motorized scooters on roadways and sidewalks.
Customer acknowledges that some states may require a driver's license and may require certain safety equipment for some or all of the Product(s) sold by UrbanScooters.com and that additional vehicle code requirements may exist. Customer undertakes sole responsibility to become informed of such applicable laws before purchasing Product(s) from UrbanScooters.com. Customer also acknowledges that riding Product(s) also creates a risk to others and customer shall determine what insurance protection he requires before purchasing Product(s) from UrbanScooters.com. YOUR INSURANCE POLICIES MAY NOT PROVIDE COVERAGE FOR ACCIDENTS INVOLVING THE USE OF THIS SCOOTER / PRODUCT(S). TO DETERMINE IF COVERAGE IS PROVIDED, YOU SHOULD CONTACT YOUR INSURANCE COMPANY OR AGENT. Some states also require the following: YOU MAY NOT MODIFY OR ALTER THE EXHAUST SYSTEM OF THE SCOOTERS TO CAUSE IT TO AMPLIFY OR CREATE EXCESSIVE NOISE OR TO FAIL TO MEET APPLICABLE EMISSION REQUIREMENTS.
Customer acknowledges and agrees that riding Product(s) from UrbanScooters.com has certain inherent risks of injury and or death, which risks increase further if the product is not used in accordance with safe riding procedures and pursuant to manufacturer's guidelines. The buyer is further aware that the usual risks, hazards and dangers of personal injury, death and disability increase when using ramps, curbs, steps, half pipes, inclines, or declines, bowls or any other structure or device. The buyer also understands that these risks, hazards and dangers are further increased when other persons, whether or not of the same level of experience or skill, are using the same Product(s).
UrbanScooters.com, its affiliates and sponsors, are neither responsible nor liable for any direct, indirect, incidental, consequential, special, exemplary, punitive or other damages arising out of or relating in any way to the Product(s) sold on this Site, Site-related services and/or content, or information contained within the Site. Your sole remedy for dissatisfaction with the Product(s) sold by this Site and/or Site-related services is to return the Product(s) in accordance with the UrbanScooters.com return policies or submit a claim to the manufacturer of the Product(s).
CUSTOMER ASSUMES THE RISK OF ALL RIDERS WHO RIDE SUCH PRODUCT(S), INCLUDING WITHOUT LIMITATION CUSTOMER HIMSELF. CUSTOMER FURTHER ACKNOWLEDGES AND AGREES THAT IT SHALL HAVE NO CLAIM FOR LIABILITY AGAINST URBANSCOOTERS.COM FOR ANY MISUSE OF ANY OF SUCH PRODUCT(S). URBANSCOOTERS.COM SHALL HAVE NO OBLIGATION AND THE PURCHASER OR USER SHALL HAVE NO REMEDY AGAINST URBANSCOOTERS.COM, ITS OFFICERS, AGENTS OR ASSIGNS FOR ANY DAMAGES, INCLUDING WITHOUT LIMITATION, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE DAMAGES ARISING FROM DIRECT OR INDIRECT INJURY TO PERSON OR PROPERTY, OR ANY OTHER LOSS, WHETHER OR NOT OCCASIONED BY NEGLIGENCE, OR OTHERWISE, ON THE PART OF URBANSCOOTERS.COM. PURCHASER ACKNOWLEDGES THAT THERE IS AN INHERENT RISK IN THE OPERATION OF MOTORIZED SCOOTERS, MOTORIZED BICYCLES, PUSH SCOOTERS, ATV'S, POCKET BIKES AND ALL PRODUCT(S) SOLD BY URBANSCOOTERS.COM, AND HEREWITH ASSUMES THE RISK OF ANY INJURY ARISING FROM OPERATION OF ANY PRODUCT(S) PURCHASED FROM URBANSCOOTERS.COM BY THE CUSTOMER, BY THE CUSTOMER'S CHILDREN OR BY ANY OTHER PERSON CUSTOMER PERMITS TO RIDE SUCH PRODUCT(S). NOTWITHSTANDING ANYTHING ELSE IN THESE TERMS AND CONDITIONS OR POSTED ON THE SITE, AND WITHOUT MODIFYING ANY OTHER LIMITATION OF LIABILITY, THE MAXIMUM LIABILITY THAT URBANSCOOTERS.COM SHALL HAVE TO A CUSTOMER AND/OR A RIDER OF PRODUCT(S) PURCHASED FROM URBANSCOOTERS.COM IS LIMITED TO ANY AMOUNTS ACTUALLY PAID TO URBANSCOOTERS.COM BY CUSTOMER. YOU ACKNOWLEDGE AND AGREE THAT THE LIMITATIONS OF LIABILITY, DISCLAIMERS OF WARRANTIES AND LIMITED REMEDIES SET FORTH HEREIN REPRESENT AN INSEPARABLE ALLOCATION OF RISK THAT IS AN ESSENTIAL BASIS OF THE BARGAIN BETWEEN THE PARTIES. Order information, such as a billing or shipping address that is inaccurate or incomplete, may result in delays that shall not be the responsibility of UrbanScooters.com.
The buyer agrees to release and forever discharge UrbanScooters.com and their agents, servants, employees, officers, directors, trustees and all other persons or entities acting on their behalf, from any and all claims, actions, damages, liability, costs or expenses and attorney fees which are related to, arise out of, or are in any way connected to the buyers participation or use of scooters or bikes and other merchandise purchased from UrbanScooters.com, use of equipment or property supplied by UrbanScooters.com, whether or not such claims, actions, damages, liability, costs or expenses are caused by the negligence of UrbanScooters.com. In consideration of buyer purchasing the Product(s) from UrbanScooters.com at the special prices offered, the buyer agrees to surrender and waive any rights to sue or exercise any legal right to seek damages from UrbanScooters.com and their agents, servants, employees, officers, directors, trustees and all other persons or entities acting on their behalf. The buyer further assumes the risk and releases UrbanScooters.com from and against all claims and liability and waives any and all rights they may have in regards to their child's activities with Product(s) purchased from UrbanScooters.com.
Original owner will indemnify and hold UrbanScooters.com harmless from and against any claims arising out of customer failing to convey all safety warnings and instructions to all riders and any subsequent owners of Product(s) sold by UrbanScooters.com. THE PRODUCT(S) FOR SALE ON THIS WEB SITE, ARE OFFERED FOR SALE WITHOUT WARRANTY BY URBANSCOOTERS.COM, EXPRESS OR IMPLIED, OF ANY KIND, INCLUDING (BUT NOT LIMITED TO) THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. CUSTOMERS SHALL RELY EXCLUSIVELY ON THE WARRANTIES PROVIDED BY THE RESPECTIVE MANUFACTURERS. CUSTOMER ASSUMES TOTAL RESPONSIBILITY AND RISK FOR HIS USE OF THE PRODUCT(S) SOLD BY URBANSCOOTERS.COM AND ALL SITE-RELATED SERVICES.
NOTICE: Some states do not allow the exclusion or limitation of incidental or consequential damages and some states do not allow limitation on how long an implied warranty lasts; therefore, some of the above limitations may not apply to you.
CANCELLATION / ORDER CORRECTION POLICY
Before completing your purchase, please confirm that you have selected the correct item(s), color(s), accessories, etc. Due to the high volume of orders we receive and the speed at which we process these orders, all sales are final.
If you contact our customer service department prior to shipment, we will make every effort to cancel or modify your order. However, if we are unable to do so, you may return it as per our Return Policy.
Customer acknowledges and agrees that due to the very small profit margins available to UrbanScooters.com, all sales of UrbanScooters.com products are final. UrbanScooters.com makes all reasonable efforts to assist Customer with any problems related to the delivery of products. Notwithstanding the foregoing, UrbanScooters.com has a very limited Return Policy which permits merchandise to be returned within 15 days of the delivery date (conditions apply, see our Return Policy for more info). Customer acknowledges Customer is responsible for return shipping and a restocking fee will apply.
MISPRICED PRODUCTS OR SERVICES
UrbanScooters.com shall have the right to refuse or cancel any orders placed for products and/or services listed at an incorrect price, rebate or refund, or containing any other incorrect information or typographical errors. UrbanScooters.com shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, UrbanScooters.com shall immediately issue a credit to your credit card account in the amount of the charge. URBANSCOOTERS.COM RESERVES THE RIGHT, AT ANY TIME, TO CHANGE ITS PRICES AND BILLING METHODS FOR PRODUCTS OR SERVICES SOLD, EFFECTIVE IMMEDIATELY UPON POSTING ON THE SITE OR BY E-MAIL DELIVERY TO YOU.
SHIPPING DAMAGE & DEFECTIVE PART(S) CLAIMS
UrbanScooters.com prides itself on selling top quality merchandise from first rate manufacturers who represent that their products pass a rigorous inspection before shipment to insure they are completely functional and free of damage. In the unlikely case a product arrives with shipping damage or a defective part, we have policies in place to make sure you're covered. Our shipping damage and defective part policy is as follows;
Inspect Your Order: If obvious shipping damage exists on delivery, make sure the carrier notes the damage before they leave. Thoroughly inspect your order within three days of delivery! If you receive merchandise with shipping damage or a defective part, you must file a claim with UrbanScooters.com within three days of delivery. All claims made after three days will not be considered shipping damage and must be resolved per your manufacturer’s warranty.
File A Claim: To file a claim, email Technical Support at email@example.com within three days of delivery. Include a detailed description and photos of all damage and/or defects, your invoice number, full name and shipping address. With this information we’ll be able to provide top-notch service and a quick resolution to your claim.
After Filing A Claim: Technical Support will review the claim. If the issue(s) is determined to be a defective part or damage resulting from shipment (and not caused by abuse, neglect or failure to follow instructions in the Owner’s Manual), support and/or replacement parts will be provided free of charge. Technical Support will begin working with you to get you on the road ASAP.
Terms and Conditions: In consideration of our discounted pricing and free shipping, all sales are final. While UrbanScooters.com has no obligation beyond the sale, we will advocate on behalf of customers to insure the manufacturer resolves instances of damage and defective part(s) upon delivery in a timely manner and we do offer a limited Return Policy. However, for a claim to be considered related to initial product delivery and for UrbanScooters.com to advocate on your behalf, your claim must be filed within three days of delivery.
If necessary, replacement parts are shipped without charge. The customer will receive technical support to install replacement parts, but it is the responsibility of the customer to physically install these parts. UrbanScooters.com will not pay Customer or a third party to install replacement parts or service the product. In some cases photographs or return shipment of the original part(s) may be required prior to service. Cosmetic damage including small rubs, scratches, blemishes, oxidation, or wear marks can occasionally occur during shipping. Customer agrees to accept all products with such cosmetic damage and technical support will assist Customer to address cosmetic damage by touch up or, as appropriate, replacement parts. Claims are typically resolved quickly and without difficulty, and we prefer to resolve claims through technical support and replacement parts. UrbanScooters.com does not resolve claims by shipping replacement merchandise. You may choose to return products delivered with shipping damage or defective part(s) per our Return Policy, however the full restocking fee will apply.
For all valid claims filed through Technical Support and communicated to UrbanScooters.com by Customer within the required three day period, we will make every effort to assist in resolving your claim with the manufacturer in a timely manner and Customer agrees to respond to service requests in a timely manner. If Customer does not respond in a timely manner, Customer agrees that his sole recourse shall be to return the unused Product(s) to UrbanScooters.com pursuant to our Return Policy, if applicable, or to pursue his claims directly with the manufacturer. Customer is not hereby waiving any rights against the manufacturer pursuant to the applicable manufacturer's warranty.
If a claim is not filed within three days of delivery, all damaged products purchased are exclusively subject to the terms of the manufacturer's warranty or claims against the shipper. The manufacturer's warranty provides no recourse for shipping damage, defect to "wear and tear" parts, and additional limitations may apply (see warranty included with merchandise for details). If damage was clearly caused during shipment, you may place a claim with the shipping company after this three day period has expired. Parts not covered by the warranty may be purchased from the manufacturer.
If you wish to return merchandise purchased from UrbanScooters.com for a refund, please review the terms and conditions below, then fill out the R.M.A. (Return Merchandise Authorization) Form located at the bottom of our Return Policy page. Within 1 - 2 business days of submitting this form, we will contact you by email with a R.M.A. number, return mailing address and further instructions. Returns for refund must be pre-authorized.

Return Terms and Conditions
* Customer must initiate return shipment of the merchandise within 15 days of the delivery date.
* Merchandise must be received in 100% new, re-sellable condition. Merchandise is not eligible for refund if it has been assembled or used.
* Merchandise must be returned in original box and packaging and arrive complete (including warranty cards, manuals, accessories, promotional items, etc.).
* Customer is responsible for returning merchandise at their own expense.
Preparing your product for return shipment:
* Re-pack the merchandise securely, include the original contents of the box; warranty cards, manuals, accessories, promotional items, etc.
* Include a copy of your invoice.
* Include a copy of the RMA notice you have received from us by email.
* Clearly print your RMA# on the return shipping label (on the outside of the box).
* For your protection we recommend all returns be sent via UPS, FedEx, DHL or other courier that issues a tracking number. We recommend that the shipment is insured. The customer is responsible for damage or loss during return shipping.
* Freight collect and COD packages will not be accepted.
Once merchandise has been returned, a refund will be applied to the account through which payment was made within four weeks. All refunds are subject to a 15% restocking fee, 20% for freight shipped items, and shipping charges are non-refundable. At the discretion of UrbanScooters.com, returns which do not follow the above guidelines may be refused and require the customer to pay return shipping and handling fees, or if accepted, may be subject to an additional restocking fee of up to 15%.
To initiate a return, fill out a RMA (Return Merchandise Authorization) form and follow the instructions provided.

LEGAL STATUS OF PRODUCTS. It is the responsibility of the buyer, not the seller, to ascertain, and obey, all applicable local, state, federal and international laws in regard to the possession, and use, of any item purchased from UrbanScooters.com. All merchandise is sold subject to public law 90-351, title III, U.S.D., Section 2511, and any local, state or federal ordinances or international law. Consult your local, state and country laws before ordering if you are in doubt. Absolutely no sales to minors. By placing an order, the buyer represents that the merchandise ordered will be used in a lawful manner and that he/she is of legal age. UrbanScooters.com will not be held liable for the misuse of any merchandise purchased. Should your item be confiscated by customs in your country, you will NOT be refunded and you waive any rights you may have to deny your payment to us. Again, if you are in doubt, check local laws before purchasing.
ACKNOWLEDGMENTS. These terms are effective and binding upon the buyer's heirs, agents, personal representatives and assigns. The buyer certifies he/she is over 18 years of age. The buyer has read the foregoing and acknowledges that he/she understands and agrees to all of the above terms and conditions. The buyer has had the opportunity to ask any and all questions regarding this agreement and the effect of the same. The buyer agrees that by purchasing items or sending payment for items, they assume all risks and waive and release certain substantial rights that they may have or possess.
ALTHOUGH URBANSCOOTERS.COM ATTEMPTS TO ENSURE THE INTEGRITY AND ACCURACY OF THE SITE, IT MAKES NO GUARANTEES WHATSOEVER AS TO THE CORRECTNESS OR ACCURACY OF THE MATERIALS CONTAINED IN THE WEB SITE. MANUFACTURERS UPDATE THE SPECIFICATIONS FOR ITS PRODUCTS FROM TIME TO TIME AND THE REVISED SPECIFICATIONS MAY BE DELAYED IN BEING POSTED TO OUR WEB SITE. IT IS ALSO POSSIBLE THAT UNAUTHORIZED PERSONS COULD MAKE ADDITIONS, DELETIONS AND ALTERATIONS TO THE SITE. URBANSCOOTERS.COM DOES NOT WARRANT THAT THE MATERIALS ON THE SITE WILL BE ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE OR THE SERVER THAT MAKES THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. URBANSCOOTERS.COM DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE OF THE MATERIALS IN THE SITE, IN TERMS OF THEIR CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE. CUSTOMERS AGREE TO RELY SOLELY ON MANUFACTURERS MATERIALS FOR THE USE AND CARE OF THE PRODUCTS SOLD BY URBANSCOOTERS.COM. THE LINKED SITES ARE FOR YOUR CONVENIENCE ONLY, AND YOU ACCESS THEM AT YOUR OWN RISK. In the event that an inaccuracy arises, please inform UrbanScooters.com so that it can be corrected. If there has been a material inaccuracy in product description, UrbanScooters.com shall act reasonably in accommodating the Customer.
PRIVACY AND DATA COLLECTION. By visiting the UrbanScooters.com site, you expressly consent to the collection and use by UrbanScooters.com of personally identifiable information, on an individual and an aggregate basis, as set forth in the Privacy and Data Collection Policy. UrbanScooters.com only collects information from customer in connection with a sale or potential sale and it is required that all customers purchasing products from this website be over the age of 18. This site does not knowingly collect information from or about persons under the age of 13.
ADDITIONAL LEGAL NOTICES. By visiting the UrbanScooters.com site, you have agreed to additional legal notices found on the Legal Page of our website.
Customer acknowledges that UrbanScooters.com accepts payment by credit card and PayPal as an accommodation to customer; but further understands that UrbanScooters.com shall take all appropriate legal action in the event payment is withheld due to credit card or PayPal irregularities or chargebacks. All returned checks and disputed payments will be assessed a $30 fee.
Customer agrees to pay all costs of collection including attorney's fees and costs, court costs, arbitration costs, service of process costs and all costs incurred by enforcement of judgment expenses, together with all costs and fees associated with reclaiming merchandise, if applicable. Customer agrees that UrbanScooters.com can submit all such claims to expedited arbitration in Los Angeles California and that the decision of the arbitrator may be enforced in any court having jurisdiction thereof. Customer agrees that service of the demand for arbitration may be to Customer's email address provided with the purchase and/or to the address for delivery of the products. Customer shall have ten (10) business days to object to the proposed arbitrator and upon such objection, the arbitration panel shall select another neutral arbitrator acceptable to UrbanScooters.com. The parties agree that the matter shall be heard before the arbitrator within thirty (30) days after the arbitrator has been selected.
This Agreement shall be governed by, construed and enforced in accordance with the laws of the State of California, as it is applied to agreements entered into and to be performed entirely with such state.
CUSTOMER AND URBANSCOOTERS.COM AGREE THAT ANY DISPUTE HEREUNDER WILL BE RESOLVED THROUGH BINDING ARBITRATION IN THE CITY OF LOS ANGELES, CALIFORNIA, PURSUANT TO THE LAWS OF THE STATE OF CALIFORNIA. BY AGREEING TO ARBITRATION, CUSTOMER ACKNOWLEDGES THAT HE IS GIVING UP ANY RIGHTS HE MIGHT POSSESS TO HAVE THE DISPUTE LITIGATED IN A COURT OR JURY TRIAL, TO SOME OR ALL DISCOVERY AND TO APPEAL.
If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severed from this agreement, and shall not affect the validity and enforceability of any remaining provisions. This is the entire agreement between the parties relating to the matters set forth herein, and shall not be modified except in writing, signed by UrbanScooters.com.
UrbanScooters.com reserves the right to change or update these terms and conditions of use at any time. Any changes or updates will be effective immediately upon posting to the site.
